Nipsey Russell, Attorney At Law, On Case For McNamee

Via the AP:

"Roger Clemens has put himself in a position where his legacy as the greatest pitcher in baseball will depend less on his ERA and more on his DNA," said one of [Brian] McNamee's lawyers, Earl Ward.

I'm guessing that Kurtis Blow is calling Clemens now - with an offer to help state his side of the case.

I heard that live on the radio and I believe there was an audible groan among a few reporters. Some chuckled, but it didn't quite go over the way he wanted it to.

In my legal opinion, the most incompetent legal maneuver by any attorney involved in the case was when Hardin played the secretly recorded tape of the conversation between Clemens and McNamee. I think it hurt Clemens's credibility and boosted McNamee's.

FWIW, when I was listening to the press conference on the way home tonight, the lawyers for McNamee claimed that he never intended to offer up the needles, etc., because he didn't want to "bury" Clemens or "throw him under a bus" - but, once Clemens played the tape, the next day McNamee decided to pony up the DNA stuff - because he was pissed that the story about his sick kid was now public.

The DNA on needles don't mean shit - Clemens himself claimed McNamee injected him with B-12. Stuff like this gets thrown out in court, and if McNamee's lawyers keep throwing out PR-moves like this, they'll get swept off the floor in court. You can almost smell the desperation from their end. Doesn't matter if Clemens used or didn't use, The best physical proof McNamee has are some syringes with Clemens' DNA on them. From 2000, 2001. Lawyers around the world are laughing.

McNamee's lawyers understand that they aren't operating in a courtroom, they're operating in the court of public opinion.

Most of the public, at least according to the public opinion polls I have seen, think that Clemens used PEDs. Rightly or wrongly, releasing this "DNA" may only cement that perception.

IMO, it's Clemens and his lawyers that sound desperate.

The real issue, however, is not McNamee and Clemens, it's Mitchell and Clemens. He is the one who named names, and relied on testimony from McNamee and Radomski.

If anyone is at fault, besides the PED users, it's Mitchell and the man who selected him to do this investigation, Bud Selig.
